We certainly picked a topical time to talk about employment entitlements on the AMT blog! If you missed Part 1, you should <a rel=\"noreferrer noopener\" aria-label=\"go back and read that first (opens in a new tab)\" href=\"http:\/\/blog.amt.org.au\/index.php\/2019\/07\/17\/how-does-your-income-compare\/\" target=\"_blank\">go back and read that first<\/a>. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Round 6<\/h4>\n\n\n\n<p>Hands up those who have ever been paid penalty rates for weekend or public holiday work? <\/p>\n\n\n\n<p>Perhaps the time has come for massage therapists to unionise. In September 2017, 8.5% of us were employed under the Award. Last month, that percentage had dropped to 6. WTAF?*<\/p>\n\n\n\n<p>Somewhat unsurprisingly, the most common area of employment inquiry to AMT Head Office isn\u2019t about the Award (because there\u2019s so freakin\u2019 few of us on it) but rather about being engaged as a subcontractor. <\/p>\n\n\n\n<p>Subcontracting is the most common form of engagement for massage therapists but it is fraught with areas of grey, both for the contractor and the business the contractor is providing services to. <\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" width=\"208\" height=\"300\" src=\"https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/burglar-157142_1280-208x300.png?resize=208%2C300\" alt=\"\" class=\"wp-image-1917\" srcset=\"https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/burglar-157142_1280.png?resize=208%2C300&amp;ssl=1 208w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/burglar-157142_1280.png?resize=768%2C1110&amp;ssl=1 768w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/burglar-157142_1280.png?resize=709%2C1024&amp;ssl=1 709w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/burglar-157142_1280.png?resize=750%2C1084&amp;ssl=1 750w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/burglar-157142_1280.png?resize=300%2C433&amp;ssl=1 300w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/burglar-157142_1280.png?w=886&amp;ssl=1 886w\" sizes=\"auto, (max-width: 208px) 100vw, 208px\" \/><\/figure><\/div>\n\n\n\n<p>Unscrupulous businesses may seek to engage therapists under <a rel=\"noreferrer noopener\" aria-label=\"sham contracting arrangements  (opens in a new tab)\" href=\"https:\/\/www.andersons.com.au\/lawtalk\/2014\/march\/sham-contracting\/ \" target=\"_blank\">sham contracting arrangements <\/a>to avoid paying the kind of entitlements that our celebrity chef George is not fond of, like penalty rates, annual leave, personal leave and superannuation. <\/p>\n\n\n\n<p><strong>Some businesses seem to labour under the false expectation that workers should share their commercial risks by effectively working below minimum wage.<\/strong> <\/p>\n\n\n\n<p>Determining whether a worker is a subcontractor rather than an employee is not straightforward or simple though. It is a complex decision-making process that involves taking into account the full context in which duties are being performed and \u2018<em>the totality of the relationship<\/em>\u2019:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p> &#8220;<em>The Fair Work Act takes the common law (based on case law precedent) view which is that the reality and the totality of the relationship between the employer and the person doing the work are the determining factors for deciding whether an employment relationship exists or that of an independent contracting relationship. <\/em><strong><em>The written terms of the contract or agreement are a consideration, to see if they reflect the reality, but are not conclusive.<\/em><\/strong><em> The Court will consider the reality of the relationship of primary importance.<\/em>&#8221; <\/p><cite><a href=\"https:\/\/www.andersons.com.au\/lawtalk\/2014\/march\/sham-contracting\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Andersons Solicitors (opens in a new tab)\">Andersons Solicitors<\/a><\/cite><\/blockquote>\n\n\n\n<p>Because of this nuance and the need to unpack the \u2018totality of the relationship\u2019, it is pretty much impossible to give specific insight or support when massage therapists ask questions about their employment status on <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.facebook.com\/groups\/amtnetworking\/\" target=\"_blank\">AMT\u2019s Facebook group page<\/a>, which has been a fairly common occurrence over the past five years.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/question-mark-213692_1280-165x300.jpg?resize=65%2C118\" alt=\"\" class=\"wp-image-1919\" width=\"65\" height=\"118\" srcset=\"https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/question-mark-213692_1280.jpg?resize=165%2C300&amp;ssl=1 165w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/question-mark-213692_1280.jpg?resize=562%2C1024&amp;ssl=1 562w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/question-mark-213692_1280.jpg?resize=300%2C547&amp;ssl=1 300w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/question-mark-213692_1280.jpg?w=702&amp;ssl=1 702w\" sizes=\"auto, (max-width: 65px) 100vw, 65px\" \/><\/figure><\/div>\n\n\n\n<p>Employsure provides <a rel=\"noreferrer noopener\" aria-label=\"some broad tips (opens in a new tab)\" href=\"https:\/\/employsure.com.au\/blog\/defining-the-relationship-between-employees-and-contractors\/\" target=\"_blank\">some broad tips<\/a> on how to identify whether someone is genuinely engaged as an independent contractor. If you are a contractor and you answer yes to any of the following questions, the nature of your employment relationship is probably being misrepresented:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Are you required to wear a uniform?<\/li><li>Do you have limited control over how&nbsp;you conduct your work?<\/li><li>Do you use equipment supplied to you? (not just massage equipment but think HICAPS terminal, record keeping software etc)<\/li><li>Are your weekly hours and times of work set by the company?<\/li><li>Are you engaged on an ongoing, continual basis?<\/li><\/ul>\n\n\n\n<p>The Australian Tax Office website (ATO) also has lots of resources to assist businesses to determine whether a worker is a subcontractor or an employee. Raise your hands if you were already aware that this is an indicator that you are an employee not a contractor? IKR! <\/p>\n\n\n\n<p>The following information is quoted almost verbatim from <a href=\"https:\/\/www.ato.gov.au\/business\/employee-or-contractor\/difference-between-employees-and-contractors\/basis-of-payment\/ \" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"the ATO website (opens in a new tab)\">the ATO website<\/a>. (I added the bit about number of massages performed.)<\/p>\n\n\n\n<p><strong>Being paid per item or activity is a characteristic of an employee. <\/strong>Price per item or activity can also be called &#8216;piece&#8217; or &#8216;piece-work&#8217; rates.<\/p>\n\n\n\n<p>You pay your worker a price per item or activity if\nthey&#8217;re paid:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>a specific amount for each item or activity they produce (for example, number of research interviews conducted, quantity of fruit picked or <strong><em>number of massages performed<\/em><\/strong>)<\/li><li>for the number of items or activities they produce during a defined time period (for example, daily, weekly or monthly).<\/li><\/ul>\n\n\n\n<p>Being paid on a commission basis is considered a price per item or activity.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Super Bonus Round<\/h4>\n\n\n\n<p> Raise your hands if your mind just blew.  <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Decisions Decisions &#8230;<\/h4>\n\n\n\n<p>The ATO website has a <a rel=\"noreferrer noopener\" aria-label=\"contractor\/ employee decision tool (opens in a new tab)\" href=\"https:\/\/www.ato.gov.au\/Calculators-and-tools\/Host\/?anchor=ECDTSGET&amp;anchor=ECDTSGET\/questions\/ECDT#ECDTSGET\/questions\/ECDT\" target=\"_blank\">contractor\/ employee decision tool<\/a>  which will help you determine whether you are being employed under the correct arrangements. It also provides information to employers\/businesses about the tax and super obligations they need to meet. Because, of course, you already knew that most massage therapist contractors are actually treated as employees for superannuation purposes under the <a rel=\"noreferrer noopener\" aria-label=\"Superannuation Guarantee Act 1992, (opens in a new tab)\" href=\"http:\/\/www.austlii.edu.au\/cgi-bin\/viewdoc\/au\/legis\/cth\/consol_act\/sga1992430\/s12.html?context=1;query=contract;mask_path=au\/legis\/cth\/consol_act\/sga1992430\" target=\"_blank\">Superannuation Guarantee Act 1992,<\/a> right? <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>&#8220;<em>If a person works under a contract that is wholly or principally for the labour of the person, the person is an employee of the other party to the contract.<\/em> &#8220;<\/p><cite><a href=\"http:\/\/www.austlii.edu.au\/cgi-bin\/viewdoc\/au\/legis\/cth\/consol_act\/sga1992430\/s12.html?context=1;query=contract;mask_path=au\/legis\/cth\/consol_act\/sga1992430\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Section 12 (3)  (opens in a new tab)\">Section 12 (3) <\/a>SUPERANNUATION GUARANTEE (ADMINISTRATION) ACT 1992 <\/cite><\/blockquote>\n\n\n\n<p>But superannuation is a more detailed blog post for next time. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">More Mythbusting<\/h4>\n\n\n\n<p>The number of myths that propel engagement\npractices in the massage industry is truly terrifying. They drive the\npathetically low rate of therapists being employed under the Award. \u201cEveryone\ndoes it\u201d might be expedient shorthand for employment policy but it ignores the\nfact that, just because something is common practice, doesn\u2019t make it lawful. <\/p>\n\n\n\n<p>Here is a quick overview of some of the myths that embed sham contracting within the massage industry. <\/p>\n\n\n\n<p><strong>Myth:<\/strong> If a massage therapist\nhas an ABN then they are a contractor. <\/p>\n\n\n\n<p><strong>Fact:<\/strong> Having or quoting an ABN makes no difference to whether a massage therapist is an employee or contractor for a job.
