The long-running campaign was remarkably sticky and Bernie entered into the Australian psyche in a way that no Reserve Bank Governor had before, or has since. <\/p>\n\n\n\n<p>If the massage industry is anything to go by, we are overdue for a whole new dose of Bernie: <a rel=\"noreferrer noopener\" aria-label=\"57% of us are not being paid superannuation or making any provisions for  (opens in a new tab)\" href=\"http:\/\/blog.amt.org.au\/index.php\/2019\/07\/17\/how-does-your-income-compare\/\" target=\"_blank\">57% of us are not being paid superannuation or making any provisions for it<\/a>. <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-style-large is-layout-flow wp-block-quote-is-layout-flow\"><p><strong><em>A generation of massage therapists are contemplating a destitute retirement.<\/em><\/strong> <\/p><\/blockquote>\n\n\n\n<p>And this concept terrifies me. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Myths\nversus facts<\/strong><\/h4>\n\n\n\n<p>In the <a rel=\"noreferrer noopener\" aria-label=\"last exciting instalment (opens in a new tab)\" href=\"http:\/\/blog.amt.org.au\/index.php\/2019\/07\/24\/when-is-a-contractor-not-a-contractor\/\" target=\"_blank\">last instalment<\/a> of this series about employment entitlements, we busted some myths about contracting. Let\u2019s pick up where we left off and bust the biggest myth that businesses like to cling to: superannuation.<\/p>\n\n\n\n<p><strong>Myth:<\/strong> My business only takes on contractors so we do not have to worry\nabout superannuation.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/zap-4335609_1280-300x187.png?resize=193%2C120\" alt=\"\" class=\"wp-image-1948\" width=\"193\" height=\"120\" srcset=\"https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/zap-4335609_1280.png?resize=300%2C187&amp;ssl=1 300w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/zap-4335609_1280.png?resize=768%2C479&amp;ssl=1 768w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/zap-4335609_1280.png?resize=1024%2C638&amp;ssl=1 1024w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/zap-4335609_1280.png?resize=750%2C468&amp;ssl=1 750w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/zap-4335609_1280.png?w=1280&amp;ssl=1 1280w\" sizes=\"auto, (max-width: 193px) 100vw, 193px\" \/><\/figure><\/div>\n\n\n\n<p><strong>Fact: <\/strong>First of all, a business cannot decide to treat a worker as a contractor when the worker is actually an employee. <strong>This is called sham contracting.<\/strong> <a rel=\"noreferrer noopener\" aria-label=\"revisit last week\u2019s blog (opens in a new tab)\" href=\"http:\/\/blog.amt.org.au\/index.php\/2019\/07\/24\/when-is-a-contractor-not-a-contractor\/\" target=\"_blank\">Revisit last week\u2019s blog<\/a> for more on how to spot the difference between an employee and a contractor.<\/p>\n\n\n\n<p>Businesses that engage massage therapists as genuine contractors may still be required to pay them super under the Superannuation Guarantee because <strong>the therapist is being paid wholly or principally for their labour<\/strong>. If a contractor cannot delegate or subcontract their services to another therapist, they are considered to be <strong>an employee for superannuation purposes<\/strong>. The threshold at which the Superannuation Guarantee obligations kick in for businesses is when a worker earns more than $450 gross a month, be they casual, full time, part time or contracting. <\/p>\n\n\n\n<p>To <a href=\"https:\/\/www.ato.gov.au\/Business\/Super-for-employers\/Working-out-if-you-have-to-pay-super\/Contractors\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"quote from the ATO website (opens in a new tab)\">quote from the ATO website<\/a>:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>Contractors paid mainly for their labour are employees for superannuation guarantee purposes. This is the case even if the contractor quotes an Australian Business Number (ABN).<\/em><\/p><p><em>You must make super contributions for these individuals if you pay them:<\/em><\/p><p><em>&#8211; under a verbal or written contract that is wholly or principally for their labour \u2013 that is, more than half the dollar value of the contract is for their labour<br> &#8211; for their personal labour and skills \u2013 which may include physical labour, mental effort or artistic effort \u2013 and not to achieve a result<br> &#8211; to perform the contract work personally \u2013 that is, they must not delegate. <\/em><\/p><cite>Australian Taxation Office<\/cite><\/blockquote>\n\n\n\n<p>Remember, <strong>it doesn\u2019t matter if you have signed a contract that says you are not eligible for super as a contractor<\/strong>. An unlawful clause in a contract is exactly that  \u2013  unlawful. (I promise you that I have seen plenty of bad clauses and sworn even more plentifully.  I saw the worst contract I have ever seen this morning and I ran out of swear words. True story.)<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft is-resized\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/superman-2478978_1920-232x300.jpg?resize=155%2C200\" alt=\"\" class=\"wp-image-1946\" width=\"155\" height=\"200\" srcset=\"https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/superman-2478978_1920.jpg?resize=232%2C300&amp;ssl=1 232w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/superman-2478978_1920.jpg?resize=768%2C994&amp;ssl=1 768w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/superman-2478978_1920.jpg?resize=791%2C1024&amp;ssl=1 791w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/superman-2478978_1920.jpg?resize=750%2C970&amp;ssl=1 750w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/superman-2478978_1920.jpg?resize=300%2C388&amp;ssl=1 300w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/superman-2478978_1920.jpg?w=1484&amp;ssl=1 1484w\" sizes=\"auto, (max-width: 155px) 100vw, 155px\" \/><\/figure><\/div>\n\n\n\n<p>If you\u2019re currently providing services to a clinic as a contractor <strong><em>and<\/em><\/strong> you have to perform the work personally (i.e. you can\u2019t delegate the work) <strong><em>and<\/em><\/strong> you are grossing more than $450 a month, you\u2019re eligible to be paid superannuation under the Superannuation Guarantee Act. <\/p>\n\n\n\n<p>But don\u2019t take my word for it. Go forth and use the <a rel=\"noreferrer noopener\" aria-label=\"TO\u2019s Super Guarantee Eligibility Tool  (opens in a new tab)\" href=\"https:\/\/www.ato.gov.au\/Calculators-and-tools\/Host\/?anchor=ECDTSGET&amp;anchor=ECDTSGET\/questions\/SGET#ECDTSGET\/questions\/SGET \" target=\"_blank\">ATO\u2019s Super Guarantee Eligibility Tool <\/a>and save the result to show the clinic you work for. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>But My Contract Says I <em>Can<\/em> Delegate the Work<\/strong><\/h4>\n\n\n\n<p>Just because your contract says you can delegate, doesn\u2019t mean that this reflects the reality of your actual circumstances. As I explained in last week\u2019s blog:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em><strong>The written terms of the contract or agreement are a consideration, to see if they reflect the reality, but are not conclusive.<\/strong> The Court will consider the reality of the relationship of primary importance.<\/em><\/p><cite><a href=\"https:\/\/www.andersons.com.au\/lawtalk\/2014\/march\/sham-contracting\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\"Andersons Solicitors (opens in a new tab)\">Andersons Solicitors<\/a><\/cite><\/blockquote>\n\n\n\n<p>Is delegation even practicable in our industry? When you stop to consider that most contractors are required to come into a clinic with provider number eligibility and that provider numbers for many major funds, including Medibank Private, are associated with a particular practice location, then the whole idea of being able to delegate or subcontract to another therapist is pretty bunk. Another therapist sure as hell ain\u2019t likely to have a provider number for that clinic. <\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft is-resized\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/question-mark-213692_1280-165x300.jpg?resize=46%2C84\" alt=\"\" class=\"wp-image-1919\" width=\"46\" height=\"84\" srcset=\"https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/question-mark-213692_1280.jpg?resize=165%2C300&amp;ssl=1 165w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/question-mark-213692_1280.jpg?resize=562%2C1024&amp;ssl=1 562w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/question-mark-213692_1280.jpg?resize=300%2C547&amp;ssl=1 300w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/question-mark-213692_1280.jpg?w=702&amp;ssl=1 702w\" sizes=\"auto, (max-width: 46px) 100vw, 46px\" \/><\/figure><\/div>\n\n\n\n<p>Raise your hand if you\u2019ve ever tested out the clause in your contract that says you can delegate to another therapist? <\/p>\n\n\n\n<p>Didn\u2019t think so. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Here\u2019s the Rub<\/strong><\/h4>\n\n\n\n<p>The overwhelming majority of massage therapists are sole traders with an ABN. But if you enter into a contract to provide services to a clinic as a company, trust or a partnership, then you\u2019re not eligible for superannuation. If you think that might be you but you\u2019re not sure and\/or you&#8217;re confused, then you need to seek legal advice. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>One More Thing \u2026<\/strong><\/h4>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/cupcake-309889_640-221x300.png?resize=72%2C98\" alt=\"\" class=\"wp-image-1951\" width=\"72\" height=\"98\" srcset=\"https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/cupcake-309889_640.png?resize=221%2C300&amp;ssl=1 221w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/cupcake-309889_640.png?resize=300%2C407&amp;ssl=1 300w, https:\/\/i0.wp.com\/blog.amt.org.au\/wp-content\/uploads\/2019\/07\/cupcake-309889_640.png?w=472&amp;ssl=1 472w\" sizes=\"auto, (max-width: 72px) 100vw, 72px\" \/><\/figure><\/div>\n\n\n\n<p>Super doesn\u2019t get paid by docking a percentage of your negotiated rate to cover the requirement&nbsp; \u2013 it\u2019s a minimum 9.5% <strong>ON TOP<\/strong> of what you have earned. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>And Another Thing<\/strong><\/h4>\n\n\n\n<p>You can use the <a rel=\"noreferrer noopener\" aria-label=\"ATO\u2019s online lodgement tool  (opens in a new tab)\" href=\"https:\/\/www.ato.gov.au\/Calculators-and-tools\/Report-unpaid-super-contributions-from-my-employer\/\" target=\"_blank\">ATO\u2019s online lodgement tool <\/a> to make a claim for unpaid superannuation any time. You just need your employer\u2019s ABN, your tax file number, your super account details and the date range over which you have not been paid super.
